In this simulation, we were tasked with successfully launch info Alleles in new markets over the next 7-10 years, effectively expanding the Alistair Brand into Latin America. We saw a 6. % growth in unit sale 18. 3% growth in manufacturer sales, 29. 7% growth in gross margin, and 60. 3% growth in net contribution. We finished in fifth place with a cumulative net contribution of $400. 6 million. Venezuela entered a recession walkway through the simulation, which prevented entrance from Alleles, and Argentina began to experience the impending effects of a recession, however, we had already invested too many resources to pull out of the country, so we had to adjust our skews to account for the change in shopping habits. Market Entry International market entry decisions are complicated. Most companies must rye to balance the benefits of increased control and the costs of resource commitment and risk [Country Manager].Factors such as international experience, firm size, market knowledge, and economic attractiveness must all be taken into account. Therefore, market entry is critical to Allele's success. Alleles is interested in entering Latin America. Due to its large population and a variety of trade enhancement actions (NONFAT, MERCURY) that have been estab lished in recent years Latin America has great potential. Before choosing which country to enter we wanted to perform a competitive analysis and selected macro-level indicators, such as economic development, to examine.We then weighed their importance. We also examined product markets, such as market size and the number of competitors. These can be seen in the country attractiveness analysis sheet in the appendix Of this report. After weighing all of our information, Alleles decided to enter Mexico market first. Alleles chose to enter Mexico through exporting the product from our home plant. Five Kiss were chosen to test the market for each type of benefit. We also wanted to implement SKU that no other competitor was using. Finally, we chose three distribution channels.In this first market, and I being essentially a test market, Alleles was somewhat successful in establishing our name in the market. With moderate success in previous markets, Alleles entered Argentina with the same SKU and distribution channels utilized in Brazil. We also weighed the cost and benefit of continuing to export from the home plant against the risk of building a plant locally to our markets. Indicators weighed in favor of building locally. Therefore, Alleles began building a plant in Brazil. In the fourth year of marketing in Latin America we decided not to enter a new market. We wanted to focus our time and attention on Mexico, Brazil AR Argentina, as well as the new plant.The plant also began to distribute to the Brazil and Argentina markets which lowered costs and increased profit. Year five did see a new endeavor for Alleles. We chose to enter the Chilean market further increasing our regional diversification.. Overall, by utilizing the â€Å"waterfall† approach and using the money made in one market to help fund efforts in new markets, Alleles was successful with our market entries. Manufacturing location and sourcingThere were many factors to consider when our company was assessing the attractiveness of building a plant in another country. Political stability, shipping expenses, market economy, natural hazards and transportation were just a few indicators that needed to be examined. Understanding these influences enabled our company to make the right decision. Brazil is one of South America's most stable and prosperous nations. It's economy outweighs that of all other South American countries and Brazil is expanding its presence in world markets. Shipping costs from Brazil to it's neighboring countries is quite cheap.According to Country Manager, hipping from Brazil to Mexico is the highest at . 040. Therefore, We would continue to ship to Mexico from o ur home Plant and use the Brazilian Plant to ship to Argentina (. 020) and Chile (. 020). Country Manager cost analysis has Brazil at the head of the pack in terms of fixed cost (1 5% cost reduction). Furthermore, building in Brazil would result in a 0% tariff in regards to Argentina and Chile. Both of these indicators pointed favorably to building in Brazil.Natural hazards are present in every country, however, it is an indicator that must be taken into account. Brazil is home to droughts in the northeast and frost in the south. These particular natural hazards aren't very severe in terms of affecting shipping further making Brazil our top choice in Plant location. Transportation was an important factor we took into account when deciding where to build Allele's plant. Having the means to transport/ship the product to market is essential. Brazil is home to 4,000 airports, 28,857 km of railways and 1 , 751 ,868 km of roadways and this doesn't take into account its shipping ports.Because there are so many options for transporting goods, the cost of goods sold can be kept reasonable. Utilizing all of these indicators, it was clear that Alleles should build in Brazil. The plant's capacity was set to the projected unit sales in Brazil for the following period because we did not want to have a large excess which would lead to avoidable loss. However, we increased our plant production capacity by 50 million units (100 million units total) after one year. This was done to meet the demand of our past sales and accommodate for our forecasted sales.We also began distributing to Argentina from our Brazil plant in effort f decreasing shipping and tariff expenses. As each period progressed we assessed the plant's capacity and adjusted accordingly, for example, we increased our plant production capacity again by 40 million units (1 40 million units total) in order to accommodate our entry into Chile. Once this capacity increase was accomplished there were no changes made to the production capacity for one year because our capacity perfectly lined up with the amount of units sold in Chile, Argentina, and Brazil.However, the following year we increased production capacity by 15 million units to accommodate projected unit sales and a further 55 million units, eased on our need forecast for the next period, the year after that. With Alleles exiting Chile in year eight, we did not increase our plant capacity again. Building our plant in Brazil proved to be a success. Alleles was able to put pressure on all other competitors, especially other domestic companies. This helped drive share of mind and sales leadership in Brazil – enabling us to more effectively compete with the local and regional competitors which were two of the market leaders.Target Marketing Strategy Target marketing strategy was an important part to make Alleles achieve success when we enter and explore a new country. In target marketing strategy, we have to determine our main potential customers, try to attract attention from them, raise our target customers' interests, convince our customers' desires and lead our customers purchasing. Therefore, we had used MIMIC and AID (Attention, Interest, Desire, Action) model to help Alleles make a right target marketing strategy for each country that we entered. Mexico Alleles chose enter Mexico market first.Based on data provided from cross- section decision analysis in Mexico, price was customer most care about with 50. % weight and product effect was second with 27. 6%. For demographic, the families was most demographics population which was 55. 9% Of customers with 62. 2% of demand. The younger was second largest demographic population (27%) with 23. 7% of demand. Insider Dealing in Hong Kong Essay

Although insider dealing has been a criminal offence under section 291 of Chapter 571, Securities and Futures Ordinance (SFO) in Hong Kong since 2003, the Securities and Futures Commission (SFC) was initially slow to prosecute offenders, commencing its first criminal insider dealing prosecution only in January 2008. Factors to be considered to commence criminal proceedings In deciding whether to commence criminal proceedings against an alleged insider dealer, the SFC will have regard to the guidelines in the prosecution policy of the Department of Justice, which require two basic factors to be considered: 1. Sufficiency of evidence The burden of proof is greater in criminal proceedings and the SFC will generally only recommend criminal proceedings where there is admissible, substantial and reliable evidence that an offence has been committed and there is a reasonable prospect of a conviction. Where there is a lack of sufficient evidence to meet the criminal burden of proof, the SFC is likely to initiate civil proceedings. 2. Public interest Whether, taking into account the circumstances of a particular case, it is in the public interest to bring a prosecution before the courts. First Criminal Case of Insider Dealing in Hong Kong In the case of HKSAR v Ma Hon-yeung (DCCC 229-240/2008) which involved Ma Hon-yeung, former Vice President of BNP Paribas Peregrine Capital Ltd, now known as BNP Paribas Capital (Asia Pacific) Ltd (BNP Paribas), an investment bank. The case is related to trading in the shares of Egana Jewellery & Pearls Ltd (â€Å"Egana†), a listed company in Hong Kong prior to an announcement made to the market on 11 Jul 2006 aboutprivatization of the company. Ma Hon-yeung learned of a proposed privatization of Egana and tipped off his girlfriend, Ivy Lo Yuk-wah and three other family members, Sammy Ma Hon-kit, Cordelia Tso Kin-wah and Ronald Ma Chun-ho, within days of becoming privy to the proposed deal. All of them bought shares in Egana before the company announced a privatization plan and made a profit as a result. Between 1 June 2006 and 6 July 2006, trading in Egana’s shares ranged between HK$1.35 and HK$1.61 with average daily turnover of 636,630 shares. Trading in the shares of Egana and EganaGoldpfeil were suspended on 7 July 2006 pending an announcement. On 11 July 2006, Egana and EganaGoldpfeil made a joint announcement about a proposed privatization of Egana. The proposal offered shareholders a choice of receiving HK$1.80 per share or one share of EganaGoldpfeil for every 1.5 Egana shares or a combination of both. Following the announcement on 11 July 2006 the share price closed at HK$1.84 with substantially increased turnover of 25 million shares. The privatization proposal was approved by shareholders and by the court and became effective on 23 October 2006. Egana was delisted on the following day. Ma acted as a financial consultant for Egana during the privatization move, which he knew was confidential, price sensitive information. Ma had counselled or procured Ivy and Sammy to trade in Egana shares. He was convicted of insider dealing contrary to section 291(1)(b). Ivy, bought 1.51 million shares in Egana between June 20 and July 6, 2006. She was convicted of insider dealing contrary to section 291(5)(a). Ma transferred a total HK$1.7 million into Ivy’s account before the privatization announcement. She later sold the shares and transferred the money back to Ma’s account. Sammy , Cordelia and Ronald bought Egana shares separately from July 6. Sammy, Ronald and Cordelia traded in Egana shares having information through Ma’s connection to Egana about the proposed privatisation. Owing to their close family relationship between Ma andhis three family members, who received and made profit by utilizing such information, all of them were convicted of insider dealing contrary to section 291(5)(a) and (8) of SFO. Ma and Ivy were given custodial sentences of 26 months and 12months respectively. Ma’s three family members were ordered to serve 200 hours of community service. Fines were also imposed in amounts equivalent to the profits they had made while dealing in Egana shares ahead of the privatization which are HK$230,000, HK$210,000, HK$330,000, HK$110,000 and HK$17,000 respectively. The Court also ordered them to pay the Securities and Futures Commission (SFC) investigation costs totaling HK$322,742. This is the first time any person has been sentenced to jail for insider dealing in Hong Kong. The family members avoided custodial sentences because they were merely opportunistic investors making use of the relevant information divulged by the vice-president. There was no evidence that they assisted him in carrying out his plot for personal gain by using insider information. The conduct of the girlfriend, on the other hand, warranted a custodial sentence as she was the person executing the plot on behalf of the vice-president. She was fully aware of his position of trust in the financial institution and had used her trading account to perpetrate the plot. As such, the court viewed her involvement in the misconduct as being much more serious than that of an opportunistic investor; community service could not adequately reflect her culpability. However, we continue to see obvious and flagrant breaches of the insider dealing laws, such as insiders and/or their families’ members will exploited the confidential information they obtained to make a gain on disposal of shares. One of the reasons may be that the punishment for insider dealing in Hong Kong is mild for the offenders.

In 2006 Albert Snyders son who was a Lance Corporal for the United States Marine Corps was killed in the line of the duty during his time in Iraq. Matthew Snyder was killed in Anbar, Iraq when he was the gunner on a Humvee that ended up rolling after hitting something. The Westboro Church decided that they would picket Matthew Snyders funeral, notifying the sanction holding the funeral in advance what they planned on doing. When the Westboro Church and its followers arrived to picket this funeral they made sure to stage the picket on public land that was adjacent to a public street. Making sure that they didnt violate any written laws they also made sure to abide by anything that was appointed to them by the police taking care of the funeral. The Church members stood outside this church during the funeral reciting different hymns and verses from the Bible. The Supreme Court made it clear that they were only going to determine this ruling ased on matters of public concern as opposed to matters of purely private significance. The Supreme Court affirmed that the picketing amounted to speech on issues that are public; they felt as if one of the main things that the First Amendment covers is the right to picket based upon public issues. Although the Supreme Court realized that Snyder had a strong claim at the time because of the circumstances that were evident, at the same time they must also hold to the law which noted that Maryland did not have a law imposing any types of restrictions on standpoint, the Supreme Court decided that Fred Phelps and his followers were in all f their legal rights to picket that funeral. The Court expressed their acknowledgment of the picketing of a US Soldiers funeral and the idea that many Americans would feel as if the Westboro Church was morally defective, but it rejected those factors as means for any type of lawsuit that could be tendered to the church. Though a Jury ended up awarding the family of Lance Corporal Matthew Snyder millions of dollars, the US Supreme Court upheld the circuit courts dismissal of the verdict over unruly circumstances. Freedom of speech is something that is considered one of the reatest things available by both sides of the political lanes. Both Conservatives and Liberals strongly believe in freedom of speech, but it is Liberals that are more likely to take the realm of expressing themselves publically. Liberals take pride in the idea of the political left, which basically outlines their devotion to Americas First Amendment the right to free speech. Although it is usually Liberals that we see voicing their opinion publically, the Westboro Church is overall a Conservative group because of what they stand for. The Westboro Church has many things in common with those that claim to be Conservative; both are against marriage equality, both are for the replacement of constitutional government with religious dogma of their particular form of Christianity, both are for the reduction of the rights of minorities and women, and both are for getting rid of reproductive rights and family planning. The case of Snyder v. Phelps places before us a choice where we ust decide between the ethical values of basic respect versus the legal right of the First Amendment, freedom of speech. From an ethical perspective, it is easy to decide this case based upon the ideas that we adopted over time that all in all became a social norm. The ethical value of respect at a funeral will easily make someone choose the side of Snyders in this case Just because over time we have established that funerals are meant to mourn and to pay respect to not only the fallen but also the family of that person. Although it may be interpreted that the reason that the Westboro Church chose to take action the way that they did was because it was necessary to get their point across, ethically it is frowned upon because of how we know funerals are supposed to take place. The Westboro Church had many options to establish the point that they were trying to get across such as the newspaper, TV, or the radio, but instead they chose to do it at a US Marines funeral which ended up working in their favor gaining them national recognition. Potter Stewart, a once US Justice wrote with regards to Ethics that, Ethics is knowing the difference between hat you have a right to do and what is right to do. This quote explains the complete ethical aspect of this case because it describes how legally, the Westboro Church had every right to do what they did that day but ethically they were in the wrong intruding on the privacy of a grieving family at a funeral service less than 300 feet away. While the Justices made it clear that they understood where Albert Snyder and his family were coming from, they also stood firm with the idea that the Westboro Church was practicing the First Amendment which allows the freedom of speech to he public. One of the Justices following the court case described the entire case as powerful. It can stir people to action, move them to tears of both Joy and sorrow, and as it did here inflict great pain. On the facts before us, we cannot react to that pain by punishing the speaker. As a nation we have chosen a different course to protect even hurtful speech on public issues to ensure that we do not stifle public debate. The problem that is now faced upon America after the ruling that the Westboro Church did nothing wrong is, how much is too much in regards to a few igns becoming too many? Would enough signs have changed the nature of the content of Westboros message towards the Snyder family? The effect of this case on the public is something that isnt necessarily brought up but it is evident in many places because you have to realize that the public mainly sees this as a case of a family being stripped of what they believe should be a quiet and peaceful funeral. With the ruling ending the way it does it has the public wondering how far the First Amendment freedom of speech can really get you and the fine print behind our US Constitution. Overall, the US Supreme Court case touches many aspects whether it is ethically, legally, politically, or socially. It is hard for most ethically driven people to accept the fact that the Westboro Church not only got no penalty for what they did at Matthew Snyders funeral, but they also received no further details about stopping the picketing of funerals. In regards to legal aspects, this case set in stone that the First Amendment freedom of speech allows for not only speech that is accepted ethically but any type of speech that strays away from a personal attack. In most of he publics opinion the Westboro Church was in the wrong that day for not allowing a grieving family time to privately mourn the loss of a family member but although what they did was frowned upon they stayed within their legal rights which forces the court to drop their case. Although Albert Snyder lost this case his family was awarded millions of dollars and they also received support of the majority of the public against the Westboro Church and their actions not only that day, but in the future. Snyder left the courtroom after the ruling with not complete satisfaction but rust that his point was spread across America which was to notify them of what the Westboro Church does and what they caused not only himself, but his family.
